Terms & Conditions of Booking & Travel

1. Definitions

Domestic Tour: A tour operated by FLWS within Australia.

International Tour: A tour operated by FLWS outside Australia (land content only; airfares are not arranged by FLWS unless expressly stated).

Confirmed Departure: A tour that has reached the minimum number of paying guests required to operate.

Tour Price: The total price payable for the tour as advised at booking (includes GST where applicable).

You / Guest: The person making a booking and/or travelling.

2. Application of these Terms

These Terms apply to all bookings made with FLWS. By booking (or travelling), you agree to these Terms on behalf of yourself and any other travellers in your booking.

Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or other laws that cannot be excluded.

3. Booking & Contract Formation

A booking is confirmed (and a contract is formed) only when:

you accept these Terms, and

FLWS receives the required payment (see section 4), and

FLWS issues a written booking confirmation (email is sufficient).

FLWS may decline a booking at its discretion (for example, where requirements in these Terms cannot be met), subject to any non-excludable consumer rights.

4. Payments

4.1 Domestic Tours – payment in full

Domestic Tours require 100% payment at the time of booking. Your place is not confirmed until cleared funds are received.

Payment plans (Domestic Tours): A payment plan may be offered at FLWS’ discretion. If offered, payment dates and amounts will be confirmed in writing. If you miss a payment, FLWS may treat this as a default and/or cancellation by you, and cancellation fees will apply (see section 7).

4.2 International Tours – deposit and instalments

International Tours are payable as follows (unless your booking confirmation states otherwise):

Deposit: 30% of the Tour Price due at booking OR another amount stated in the tour information

Second instalment: additional 30% due once the tour is a Confirmed Departure (minimum numbers met) OR another amount stated in the tour information. FLWS will notify you when this occurs and provide the due date.

Final balance due 90 days prior to departure.

Bookings made within 90 days of departure may require full payment immediately (as advised by FLWS).

4.3 Payment method fees

If you pay by credit/debit card, a surcharge may apply and will be disclosed at the time of payment. The surcharge will not exceed the reasonable cost of accepting that payment method.

4.4 Payment processing fees (Stripe)

Where a refund is otherwise payable under these Terms, the refund may be processed less any non-refundable payment processing fees charged by our payment provider (for example, Stripe). FLWS will provide a record of the deducted fees on request.

5. Tour Minimum Numbers & Confirmed Departure

5.1 Minimum numbers

Domestic Tours: Minimum 8 paying guests. FLWS will decide whether to proceed and notify guests no later than 60 days before the tour start date.

International Tours: Minimum 8 paying guests. FLWS will decide whether to proceed and notify guests no later than 120 days before departure.

5.2 If FLWS cancels (including for minimum numbers)

If FLWS cancels a tour for any reason, you will receive a full refund of all amounts paid to FLWS for that tour (including any deposit). Refunds are returned to the original payment method where possible.

To the extent permitted by law, this is FLWS’ limit of liability and we are not responsible for other costs you may incur (for example, airfares booked independently, visas, travel insurance, or personal expenses).

6. Changes by FLWS

We may need to make changes due to operational, safety, supplier, weather or other reasons outside our control. We may change:

accommodation to a comparable standard,

itinerary order or timings,

included venues/experiences,

transport arrangements,

guides/hosts or local operators.

We will notify you of material changes as soon as reasonably possible.

6.1 Exchange rate adjustments (International Tours only)

International Tours may be priced based on exchange rates at the time of launch. If the relevant exchange rate moves by more than 10% (as measured using a publicly available exchange rate source selected by FLWS acting reasonably), FLWS may adjust the remaining balance payable.

If an adjustment is applied, FLWS will notify you in writing and provide a due date for payment. Failure to pay by the due date may be treated as non-payment/default and cancellation fees will apply (see section 7).

7. Cancellations by You (Guest)

We strongly recommend you obtain appropriate travel insurance at the time of booking (see section 10). Cancellation must be made in writing to he***@***********************ty.com
and is effective when received by FLWS.

7.1 Domestic Tours – no refunds

For Domestic Tours, if you cancel for any reason, you will be charged a cancellation fee up to 100% of the Tour Price. This means no refund will be payable (except where required by law).

7.2 International Tours – cancellation fees

For International Tours, cancellation fees apply as follows:

(a) Cancellation 90 days or more prior to departure

If you have paid only the deposit (30%), you forfeit the deposit and any additional amounts paid above the deposit will be refunded.

If you have paid the deposit + second instalment (60%), you forfeit that 60% and any additional amounts paid above 60% will be refunded.

(b) Cancellation less than 90 days prior to departure
You will be charged a cancellation fee up to 100% of the Tour Price. This means no refund will be payable (except where required by law).

8. Transfers / Substitutions (Name Changes)

You may transfer your booking to another person, subject to the conditions below. The replacement guest must accept these Terms and provide all required details including dietary information, emergency contact details and other key information requested by FLWS.

Domestic Tours: Transfers are permitted with no fee.

International Tours: Transfers are permitted subject to a $250 administration fee.

For both domestic and international tours you are responsible for any third-party costs associated with a transfer (for example, hotel/operator amendment charges), if applicable.

9. Rooming & Single Supplements

No guaranteed room matching: FLWS does not operate an ongoing roommate matching service. From time to time, FLWS may assist guests seeking a “willing to share” arrangement, but this is not guaranteed.

If no match is secured: If a twin-share match is not confirmed by:

60 days before a Domestic Tour starts, or

120 days before an International Tour departs,
the guest will be required to pay the full single room rate/supplement.

10. Travel Insurance (Mandatory – International Tours)

Travel insurance is mandatory for all International Tours.

You must provide a copy of your travel insurance Certificate of Insurance to FLWS:

no later than 90 days before departure, or

if booking within 90 days of departure, within 48 hours of booking.

If you do not provide proof of insurance: FLWS may issue written notice requiring you to remedy this within a reasonable time (for example, 5 business days). If you do not remedy, FLWS may treat this as a guest default and/or cancellation by you, and the applicable cancellation fees will apply (which may be up to 100% of the Tour Price depending on timing).

You are responsible for ensuring your policy is appropriate for your circumstances. FLWS does not provide insurance advice.

11. Health, Fitness to Travel, and Safety

You must ensure you are medically and physically fit to participate in the tour and its activities, including typical walking, standing, stairs, and getting in/out of vehicles/boats where applicable.

You must:

disclose relevant medical conditions and mobility limitations when requested,

advise FLWS of dietary needs and allergies (noting that accommodation is not always possible),

follow safety instructions from FLWS and suppliers.

If, in FLWS’ reasonable opinion, your participation poses a safety risk to yourself or others, or significantly disrupts the tour, FLWS (and/or suppliers) may refuse participation in specific activities or the tour overall. In such cases, no refund will be payable (except where required by law).

12. Assistance Animals and Accessibility

Where legally applicable, FLWS will seek to accommodate registered assistance animals; however, acceptance is subject to supplier/venue requirements and local laws. Guests requiring accessibility support or assistance should notify FLWS as early as possible so we can try to accommodate needs.

13. Behaviour, Alcohol and Illegal Substances

Tours involve wine experiences and responsible consumption is expected.

You must:

behave respectfully toward other guests, staff, and suppliers,

comply with venue rules (including Responsible Service of Alcohol requirements),

not possess or use illegal substances.

FLWS and suppliers reserve the right to refuse service or remove a guest from an activity or the tour where behaviour (including intoxication) is unsafe, disruptive, or unlawful. No refund will be payable in these circumstances (except where required by law).

14. Passports, Visas, and Entry Requirements (International Tours)

You are responsible for ensuring you meet all passport, visa, vaccination/health and entry requirements for the destination(s) you visit. If you are denied entry or services by any authority or supplier for any reason, no refund will be payable (except where required by law).

15. Inclusions, Exclusions and Personal Expenses

Your booking confirmation will specify inclusions and exclusions. Unless expressly included, you are responsible for personal expenses including (but not limited to) minibar, laundry, room service, additional drinks, souvenirs, and discretionary purchases.

16. Force Majeure / Events Outside Our Control

FLWS is not responsible for delays, changes, cancellations or losses caused by events outside our reasonable control, including (but not limited to) natural disasters, extreme weather, pandemic-related restrictions, government actions, strikes, transport disruptions, or supplier failures.

Where a force majeure event occurs, FLWS will act reasonably to adjust the tour and/or provide options where feasible. Refunds (if any) will be limited to amounts actually recoverable from suppliers, except where required by law.

17. Liability

To the extent permitted by law:

FLWS acts as tour operator for the tour arrangements described, and also relies on third-party suppliers (accommodation, venues, transport, guides).

FLWS is not liable for the acts, omissions or defaults of third-party suppliers, except where required by law.

FLWS is not liable for indirect or consequential loss (for example, loss of enjoyment, loss of opportunity, or out-of-pocket costs not paid to FLWS), except where such limitation is not permitted by law.

Nothing in these Terms limits liability for non-excludable consumer guarantees.

18. Photography, Video and Testimonials

FLWS may take photographs and video during tours for marketing and promotional purposes. If you do not wish to appear in marketing materials, you must notify FLWS in writing before the tour. FLWS will take reasonable steps to respect your request.

19. Complaints and Dispute Resolution

If you have a concern during the tour, you agree to raise it promptly with the host/FLWS so we can try to resolve it on the spot.

If the matter is not resolved during the tour, you must lodge any written complaint to he***@***********************ty.com
within 14 days after the tour ends, providing sufficient detail for us to investigate.

FLWS will respond within 7 business days of receiving your written complaint.

If a dispute remains unresolved, the parties agree to first attempt to resolve it in good faith (including by informal negotiation and, if appropriate, mediation) before commencing legal proceedings, subject to urgent relief and any non-excludable rights.

20. Governing Law

These Terms are governed by the laws of New South Wales and the Commonwealth of Australia. The parties submit to the non-exclusive jurisdiction of the courts of New South Wales.

21. Your Privacy

Any personal information you provide to us will be collected, stored, used, protected and shared in accordance with Australian Privacy Principles, and our Privacy Policy, which is published here.

22. Assignment / Novation

FLWS may assign or novate its rights and obligations under these Terms to a related body corporate or to any successor entity (including in connection with a restructure, sale or transfer of the business), provided that this does not materially reduce your rights under these Terms. We will give you written notice of any assignment or novation.

23. Third-party suppliers and liability limits

Tour services may be provided by independent third-party suppliers (including accommodation providers, venues, transport operators and guides). Those suppliers may impose their own terms and conditions, and in some cases their liability may be limited by applicable laws and/or international conventions (for example, where a third-party carrier is involved). To the extent permitted by law, FLWS is not responsible for the acts or omissions of third-party suppliers and relies on any lawful limitations of liability available to it and/or those suppliers.
